Rauch Safety & Engineering (RSE)

1. Purpose of the Program

The Standing Owner’s Engineer Program is an annual engagement under which RSE maintains a continuing owner’s-side engineering position on an asset’s building maintenance unit, façade access, and fall-protection systems: maintenance of a working engineering record, an annual engineering review delivered as the Annual Owner’s Report, a defined number of Decision Reviews, and a defined standing engineering access allowance.

2. Nature of the Program

RSE serves as the owner’s engineer. The program is conducted independently of any supplier, installer, or service provider. It is not a maintenance or service contract and does not replace inspections, testing, certifications, or other obligations required under applicable regulations.

Program deliverables describe records and engineering conditions relevant to the owner’s decisions; their purpose is not to assign fault or responsibility to any party.

3. Scope and Boundaries

The scope of each program year — included deliverables, the number of Decision Reviews, the standing access allowance, the response standard (acknowledgment and initial engagement, not completed determination), and standing terms for additional services — is defined in a standing engagement letter.

Services beyond the included scope proceed only with the owner’s authorization. Matters requiring design engineering, calculations, field investigation, specifications, procurement, project management, or delivery oversight are separate engagements.

The program does not obligate the owner to retain RSE for any resulting work, and the possibility of a subsequent engagement does not change the engineering basis on which program reviews are performed.

4. Engagement and Relationship

Inquiry about, or intake toward, the program does not create an engineering, advisory, or client relationship.

The Service Agreement & Records Review is the program’s entry baseline: a completed Review becomes the baseline of a new standing engagement, and owners entering the program directly have the Review performed as the first step.

Each engagement is formed only on execution of the standing engagement letter and payment as that letter provides; renewal is by mutual election at each annual term.

5. Records and Use of Findings

The owner remains custodian of its official records; RSE maintains the working engineering record used in performing the program, incorporating records as the owner provides them.

Program deliverables, including the Annual Owner’s Report and Decision Review outputs, are provided solely to assist the client in administering the asset.

They are not prepared as expert reports or for use in connection with any claim, dispute, litigation, arbitration, regulatory proceeding, or other adversarial matter; any subsequent use of a deliverable for a purpose outside the scope of the engagement does not alter the purpose for which it was prepared, expand RSE’s scope of services, or constitute RSE’s agreement to provide opinions or participate in such matter, and any services requested for such a purpose require a separate written engagement.

Handling of records and deliverables is governed by the Confidentiality & Information Protection Policy and the engagement agreement. RSE’s duties are those defined in the standing engagement letter for the current term; no duty continues after the end of a term absent renewal or a separate written engagement.
