1. Purpose

Rauch Safety & Engineering, Inc. (“RSE”) is entrusted with sensitive project, organizational, and technical information. This policy defines how information is collected, handled, protected, and disclosed in connection with:

  • engagement requests,
  • assessments,
  • engineering services,
  • technical documentation,
  • and published reference materials.

Protection of confidential information is essential to maintaining professional integrity, client trust, and life-safety accountability.

2. Scope

This policy applies to all information received, generated, or held by RSE in connection with:

  • the Engage RSE intake process,
  • the Rauch Access Readiness™ Assessment,
  • Design Validation Memos and related analyses,
  • engineering reviews and technical services,
  • communications with clients, consultants, or subcontractors,
  • the Comprehensive Design Guide for Work at Height & Access Systems.

This policy applies to information in all forms, including written, electronic, visual, and verbal.

3. Definition of Confidential Information

“Confidential Information” includes, but is not limited to:

  • project designs, drawings, models, and specifications,
  • access strategies, rescue concepts, and lifecycle analyses,
  • assessment submissions and results,
  • Design Validation Memos and draft findings,
  • operational procedures and maintenance practices,
  • proprietary methods, tools, or frameworks,
  • commercial terms and engagement details,
  • non-public organizational or facility information.

Confidential Information may originate from clients, project partners, or RSE itself.

4. Information Collected Through Engagement & Assessment

4.1 Engagement Requests

Information submitted through the Engage RSE form is used solely to:

  • evaluate scope alignment,
  • determine engagement suitability,
  • route requests internally.

Submission of information does not create a client relationship.

4.2 Access Readiness Assessment

Information submitted through the Rauch Access Readiness™ Assessment:

  • is self-reported by the participant,
  • is not independently verified unless part of a formal engagement,
  • is used to generate assessment outputs for the submitting party.

Assessment data is treated as confidential and is not shared externally without authorization.

5. Use and Disclosure of Confidential Information

RSE will not disclose Confidential Information except:

  • as required to perform agreed services,
  • with the explicit consent of the information owner,
  • when required by law, court order, or regulatory authority,
  • to professional advisors (legal, insurance) under confidentiality obligations.

RSE does not sell, license, or commercially exploit client Confidential Information.

6. Internal Access & Safeguards

Access to Confidential Information is limited to individuals who require it for legitimate professional purposes.

RSE implements reasonable safeguards, including:

  • access controls,
  • secure storage practices,
  • limited internal distribution,
  • role-based access where applicable.

Absolute security cannot be guaranteed; however, RSE exercises professional diligence consistent with its role and scale.

7. Third-Party Disclosure & Subcontractors

Where subcontractors or collaborators are engaged:

  • disclosure is limited to information necessary for defined scope,
  • confidentiality obligations are imposed contractually,
  • disclosure does not transfer responsibility or ownership.

RSE does not disclose Confidential Information to OEMs, vendors, or partners for marketing or sales purposes.

8. Design Guide & Public Materials

The Comprehensive Design Guide for Work at Height & Access Systems is a published reference document.

While publicly accessible, the Design Guide:

  • does not disclose project-specific confidential information,
  • does not replace project-specific engineering,
  • does not authorize reuse of proprietary RSE methods beyond permitted use.

Use of the Design Guide does not grant access to confidential engagement materials.

9. Retention & Destruction

RSE retains Confidential Information only as long as reasonably necessary to:

  • perform services,
  • meet professional obligations,
  • satisfy legal or insurance requirements.

Information may be securely archived or destroyed in accordance with internal practices.

10. No Public Use or Representation

Confidential Information may not be:

  • published,
  • shared publicly,
  • used in marketing,
  • or represented as endorsed or approved by RSE

without explicit written authorization.

11. No Waiver of Privilege or Rights

Disclosure of information to RSE does not waive any legal privilege, ownership right, or intellectual property right held by the information owner.

12. Limitations

This policy does not override:

  • applicable law,
  • court orders,
  • regulatory requirements.

Where conflicts arise, legal obligations prevail.

13. Policy Updates

This policy may be updated periodically.
The most current published version governs.

14. Governing Law

This policy is governed by the laws of the State of Nevada, without regard to conflict-of-law principles.
